NY Child Support Calculations

The New York State Office of Child Support provides guidelines to determine how much child support will be ordered. The amount is typically calculated using a set formula, based on the parents' combined income, the custody arrangement, and the number of children in need of support.

Let's take a closer look at the main factors that influence child support in New York:

  • Each parent's net income. This may include salaries, bonuses, commissions, and other sources of income each parent receives, minus certain taxes. If one parent makes more than the other, they would be responsible for more of the overall child support amount.
  • The number of children. Child support will be determined based on the number of children. As of 2023, the child support amount for 1 child is 17% of the parents' combined net income. For 2 children, it is 25%. For 3 children, the total amount is 29%. For 4 children, the amount increases to 31%; for 5 children, the total amount is no less than 35%.
  • The custody arrangement. If one parent has sole custody, the other parent would be responsible for paying their child support amount to the custodial parent. If parents share custody, the lesser-earning parent may still be eligible for child support payments.
